For updating or modificating, the OEM have to submit their Rom to Microsoft’s Sustained Engineering team for testing and certification. Then Microsoft will push the update to the phones’ OTA or reject it, and the users will download it via Zune software. It means that updates was never done OTA. The things done OTA are just update notifications and scanning.

With the explanation, it is clear that Mobile Operators don’t have any control for the final process. Just take your sim card from your phone and the OTA services will go through WiFi that bypassing the network carrier. Plug in your device and update via Zune.
